Terms of Service

The service

Reach is outreach software made by Upward Technologies B.V., Breda, the Netherlands (Chamber of Commerce 42169743): it manages contacts, sends campaigns from mailboxes you connect, and measures whether that mail arrives. Accounts with access to it can also read our investor list.

Reach is in beta. Things will break, features will change, and data may be lost. Do not rely on it as your only record of anything.

Your account

Keep your password to yourself and tell us if you think somebody else has it. What happens under your account is your responsibility.

You may not share access with people who have not paid, and you may not use an automated tool to pull the investor list out of the product.

The investor list

Access buys the right to read and search the list inside Reach, and to save individual records into your own workspace so you can write to them, for as long as your access lasts. It does not transfer the data to you and does not give you ownership of any of it.

You may contact the people you find through it, using your own judgement about whether you are entitled to. You may not take the list out of Reach: no exporting, no scraping, no copying it into another system, no republishing, selling or passing it on. Saving records you intend to write to is fine; building your own copy of the list is not. If your access ends, so does your right to use anything you took from it, and we may remove records you saved from the list.

We do not promise the list is complete or accurate, and we do not promise anybody will reply.

Contributing contacts

You may add contacts you know. When you do, you confirm that you may lawfully share their business contact details with us, and that you are not bound by any confidentiality obligation that would prevent it.

Contributed records become readable by other customers once we have checked them. You keep no rights over a record you contribute, and we may remove it at any time.

If a contribution turns out to be one you were not entitled to make, you are responsible for the consequences, and we may remove it, remove your access, or both.

Sending mail

When you send through Reach you are the sender. You decide who to write to and what to say, and you are responsible for whether that is lawful where you and the recipient are.

You may not send anything unlawful, misleading, or abusive, and you must honour opt-outs. We may suspend an account that is generating complaints, because one sender damages delivery for everyone.

Payment

A new account can use Reach free for a trial period, shown when you sign up. After that, using Reach needs a subscription. The price is shown before you subscribe, it is billed monthly in advance through Stripe, and VAT is added where it applies.

You can cancel at any time and access continues to the end of the month you have paid for. If a payment fails, Stripe tries again, and access stops if it keeps failing.

During beta we may change what is included in a plan. If we change it in a way that matters, we will tell you first.

Ending it

You can stop using Reach whenever you like and delete your account. We can end your access if you break these terms, do not pay, or use the product in a way that puts our sending reputation or other customers at risk.

When an account is closed we delete its data, other than what we have to keep, records of contributions and their consent, and anything on the suppression list.

Liability

Reach is provided as it is. To the extent the law allows, we are not liable for lost business, lost data, or anything you could not reasonably have expected. Nothing here limits liability that cannot be limited.

These terms are governed by Dutch law.
